Terms of Service

Version 1.0. Effective 14 September 2026.

These Terms govern your use of the Service. By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

The Service is operated by Axiom Tools, ABN 30 132 181 813 (“we”, “us”, “our”). Axiom Tools is a sole trader business. The individual who holds that ABN is the party you contract with, and can be identified through the Australian Business Register at abr.business.gov.au. We are an online business, and the way to reach us is by email at support@axiomtools.au.


1. Definitions and Interpretation

Approved Content means Generated Content that you have reviewed and authorised for publication.

Connected Account means a social media account you have authorised us to publish to through the Service.

Generated Content means marketing copy, content plans, and related material produced by the Service using AI.

Platform means a third-party social media service, including Facebook, Instagram, TikTok, X, LinkedIn, Reddit, Hacker News, and Product Hunt.

Service means the marketing content and scheduling service we provide at axiomtools.au.

Subscription means a paid plan giving access to the Service.

You means the person or business using the Service.

Headings are for convenience and do not affect interpretation. “Including” means “including without limitation”.


2. Nature of the Service

The Service is a marketing content and scheduling tool. It generates draft marketing copy using AI, schedules it, and publishes content you have approved to social media accounts you connect.

We are not a marketing agency, and we do not provide marketing, legal, financial, or professional advice. The analysis and recommendations the Service produces are automated, derived from your own account’s data, and are not advice.

You are the publisher of everything published through the Service. Content appears under your name and your brand, and you are responsible for it.


3. Eligibility and Account Registration

To use the Service you must be at least 18 years old and able to form a binding contract.

You must provide accurate registration information and keep it current. You are responsible for your account credentials and for everything done under your account. Tell us promptly at support@axiomtools.au if you believe your account has been accessed without your authorisation.

You must have the authority to connect the accounts you connect, and the authority to publish on behalf of the business you are marketing.


4. Use of the Service

Subject to these Terms and to your Subscription, we grant you a non-exclusive, non-transferable, revocable licence to use the Service for your own business purposes.

You must not:

We may suspend an account whose activity is causing a Platform to restrict our application. One user’s behaviour can cost every other user their integration, and we will act to protect the Service.


5. Your Content and Generated Content

Your content. You own your business information and everything published under your accounts. You grant us the rights necessary to store and process that material in order to provide the Service and to publish it as you direct, and nothing more.

Generated Content.

Generated Content is produced by an AI model and may be inaccurate, misleading, or unsuitable. It may make claims about your business that are not correct. It is a draft for your review, not a finished product.

You must review Generated Content before approving it. Approval is your confirmation that the content is accurate and suitable for publication. Once approved, it is your content and your responsibility.

Similar content may be generated for other users. Generated Content is not exclusive to you, and we make no representation that it is original or that it does not resemble content produced for others.

No guarantee of results. Marketing outcomes depend on factors outside the Service, including your offer, your market, and each Platform’s own distribution decisions. We do not promise any particular level of reach, engagement, followers, leads, or sales.


6. Connected Accounts

Authorisation. Connecting an account authorises us to publish Approved Content to it and to retrieve aggregate performance data on those posts. It authorises nothing else.

You remain bound by Platform terms. Your relationship with each Platform is yours. Their terms apply to everything published through the Service, and nothing in these Terms overrides them.

Platform actions are outside our control.

Platforms may restrict, suspend, or terminate your account for reasons of their own, including reasons related to content published through the Service. We do not control their decisions and are not liable for them.

We use official Platform APIs within their published rate limits, and we do not use unofficial endpoints or automation that Platforms prohibit.

Platform changes. Platforms change their APIs, permissions, and terms without notice, and may withdraw access entirely. Features may stop working as a result, and a Platform may become unavailable through the Service. When that happens we will post a notice at axiomtools.au. That notice is the only notification we commit to: it is written and published by hand, and the Service does not send one to you. It is not a breach of these Terms.

Revocation. You may disconnect any account at any time. Publishing to it stops. Content already published stays published, because the Platform holds it and we do not; you remove it there.


7. Scheduling and Publishing

We take reasonable steps to publish Approved Content at the times you schedule. We do not guarantee that any particular post will publish at any particular time, or at all.

Publishing depends on Platform availability, the validity of your access tokens, Platform rate limits, and factors outside our control.

Publishing failures are shown to you in the app. A post that failed, a connection that has stopped working, and a manual post that is overdue each appear in the alert area shown on every screen, and on the post itself. We do not send email, SMS, or push notifications about them, so you see a failure when you next sign in. Check the app if publishing matters to you on a particular day.

You may edit, reschedule, or cancel anything that has not yet published. Once published, the content is held by the Platform and you remove it there.


8. Third-Party Credentials

Some Platforms require you to supply your own API credentials from a developer account you create and control. X is one of them. Where you supply credentials:


9. Subscription and Payment

Trial. New accounts receive a 14-day trial. A payment method is required to start it. At the end of the trial your Subscription begins automatically and your payment method is charged, unless you cancel before the trial ends. There is no free tier.

Billing. Subscriptions are billed in advance through Stripe, at the price and interval shown at checkout, and you authorise us to charge your payment method for each period. All prices are in Australian dollars and include GST where applicable. A receipt for each payment is available from the billing portal in the app. Subscriptions renew automatically until cancelled.

Price changes and material reductions. We will give you at least 14 days’ notice, by email or in the app, before any price increase or material reduction in features takes effect. A change of either kind takes effect at your next billing period. If you do not accept it, cancel before it applies.

Failed payment. If a payment fails we may suspend access until it is resolved.

Cancellation. You may cancel at any time, from the billing screen in the app, through a process at least as simple as subscribing was. Your Subscription continues until the end of the period you have paid for, and is not renewed. On cancellation, scheduled posts stop publishing, Connected Accounts are disconnected and their stored credentials deleted, and your data is retained in accordance with the retention schedule in our Privacy Policy.


10. Refund Policy

We offer a 14-day satisfaction guarantee from the date of your first Subscription payment. Ask within that window at support@axiomtools.au and we will refund that payment in full.

After that window, refunds are at our discretion. We do not generally refund partial periods.

Nothing in this section limits your rights under the Australian Consumer Law, including your right to a refund for a major failure as defined in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Section 12 sets out the guarantees that cannot be excluded and the remedies that come with them.


11. Intellectual Property

We own the Service, including its software, design, and documentation, and all intellectual property rights in it. These Terms grant you a licence to use it and transfer no ownership.

You own your business information and your content. Generated Content, once you have approved it, is yours to use for your own business purposes, subject to the non-exclusivity described in section 5.

You may not use our name, logo, or branding without our written permission.


12. Disclaimer of Warranties

Australian Consumer Law. Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law, or by any other applicable law, that cannot be excluded, restricted, or modified by agreement.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Subject to the two paragraphs above and to section 13, and to the maximum extent permitted by law:

The Service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or secure, or that any defect will be corrected.

13. Limitation of Liability

Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), or by any other applicable law, that cannot be excluded, restricted, or modified by agreement. Where our liability under the Australian Consumer Law can be limited, it is limited, at our option, to resupplying the Service or to paying the cost of having it resupplied.

Cap. Subject to the paragraph above, our total aggregate liability arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), statute, or otherwise, will not exceed the greater of:

You indemnify us against claims, liabilities, losses, and reasonable costs (including legal costs) arising from:

This does not apply to the extent the claim arises from our own breach of these Terms or our own negligence.

Nothing in this section excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law, and this indemnity does not apply to the extent that giving effect to it would contravene that Law.

Approval is the point at which responsibility transfers. Generated Content is our draft; Approved Content is your publication.


15. Account Suspension and Termination

You may close your account at any time from within the app.

We may suspend or terminate your account if you breach these Terms, if your payment fails and is not resolved, if your activity is causing a Platform to restrict our application, or if we are required to by law.

Where the breach can be remedied, we will give you notice describing it and a reasonable opportunity to remedy it before we suspend or terminate. We may act without that notice only where the breach cannot be remedied, where waiting would expose us or another user to legal or Platform risk, or where the law requires us to act immediately.

We may also discontinue the Service, or any Platform integration within it, on reasonable notice. If we discontinue the Service entirely we will refund the unused portion of any prepaid Subscription.

On termination your licence ends, publishing stops, and Connected Accounts are disconnected. Data is handled in accordance with our Privacy Policy.


16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.

Before starting proceedings, you agree to try to resolve the dispute by:

  1. Writing to us at support@axiomtools.au setting out the dispute, and negotiating in good faith for 30 days.
  2. If that fails, attending mediation, with the mediator and their cost shared equally.

Neither step prevents either of us from seeking urgent injunctive relief.


17. General Provisions

Entire agreement. These Terms and our Privacy Policy are the entire agreement between us about the Service.

Changes. We may amend these Terms. Where a change is material we will give you at least 14 days’ notice by email or through the app. Continuing to use the Service after it takes effect means you accept it.

Severability. If a provision is unenforceable it is severed and the rest continues.

Waiver. A failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms without our written consent. We may assign them on notice, for example on a sale of the business.

Force majeure. Neither party is liable for a failure to perform caused by events outside its reasonable control.

Notices. We will send notices to the email address on your account. You send notices to support@axiomtools.au.
